Band name legalities?

I hate to tell you but a Rose is still a rose no matter how you spell it. The first thing you should do is find out if the other "owner's" have registered their name. If they have then the only thing you can do is check with them and see if they will give you permission to use the name or somehow work it out between you, otherwise I would start coming up with another name. If you do have to do that you need to file an umed Name Certificate with your county/state so no one can use your new name without coming to you.
